ทั้งนี้จะมีการลดราคา, ไม่คิดเงินบวกเพิ่ม หรือทำเกินราคาในบางงานค่ะ ตัวงานไฟล์เต็ม .psd ผู้คอมมิชจะเป็นเจ้าของแต่เพียงผู้เดียว
ลิขสิทธิ์ในตัวผลงานยังคงเป็นของนักวาด นักวาดมีสิทธิ์นำผลงานไปต่อยอดอื่น ๆ ได้ทั้งหมด ส่วนผู้จ้างสามารถนำภาพไปทำอะไรต่าง ๆ ต่อยอดได้ในกรณีที่ไม่ใช่ commercial use

Disclamier

1 – เราจะไม่ส่งขั้นตอนรัฟสีเว้นแต่ลูกค้าจะมีการแจ้งก่อนนะคะ ขั้นตอนรัฟสีเป็นเพียงการเช็กสีคร่าว ๆ โดยรวมเท่านั้น
ไม่ได้หมายความว่า finish จะเป็นแบบนั้น 100% ดังนั้นในจุดเล็ก ๆ น้อย ๆ ที่ต้องการให้ปรับในขั้นตอนนี้เราจะไม่แก้ให้ดู แต่จะแก้ให้เห็นใน finish เลยนะคะ2 – โดยมากในขั้นตอนลงสียังสามารถปรับเปลี่ยนดีเทลบางจุดได้ค่ะ หากจุดที่เปลี่ยนไม่ใช่ภาพโดยรวมของงาน
เราจะไม่นับเป็นการแก้งานที่จะมีการชาร์จเงิ่นเพิ่ม (เว้นแต่เกินจำนวนโควต้าแก้ไข)3 – ขั้นตอนการทำงานสามารถเปลี่ยนแปลงได้ตามการตกลงงานในแต่ละครั้ง

ข้อตกลง

1. ลิขสิทธิ์ของผลงานถือเป็นของผู้วาด ไม่อนุญาตให้แอบอ้างว่าวาดเอง (กรณีเป็นออริของลูกค้า ลิขสิทธิ์ของตัวละครจะเป็นของลูกค้าเหมือนเดิมค่ะ)
2. หากต้องการใช้ในเชิงพาณิชย์ โปรดแจ้งก่อน – ไม่อนุญาตให้นำงานไปใช้โฆษณาที่แสวงผลกำไร หรือเป็นสินค้า ยกเว้นแต่มีการคุยตกลงงานกันเรียบร้อยแล้ว
3. ไม่อนุญาตให้ คัดลอก/เทรซ ผลงาน
4. สามารถนำผลงานไปโพสต์ตาม sns ได้ (facebook, twitter (x) , ig , fediverse, bsky, toyhouse และอื่นๆ)
โดยไม่เป็นการแอบอ้างผลงาน (หากต้องการใส่เครดิตผู้วาดด้วย สามารถใส่ชื่อ ‘LavyPlus’ ได้เลยค่ะ ขอบคุณนะคะ)
5. ผู้จ้างงานสามารถนำภาพไปปรับสี ใส่ตัวอักษร ครอปภาพ ด้วยตัวเองได้
6. ผู้วาดจะนำผลงาน commission ที่ย่อไซส์ และใส่ลายน้ำแล้วไปเผยแพร่บน sns ต่าง ๆ ของผู้วาดเอง
หากไม่ต้องการให้แพร่ในทันทีโปรดแจ้งระยะเวลาที่ต้องการให้อุบภาพไว้กับผู้วาดก่อนนะคะ
7. ผู้วาดจะส่งงานที่เสร็จแล้วผ่าน google drive หรือเว็บไซต์รับงาน อาทิ Vgen, Arbum เท่านั้น และจะเก็บผลงานไว้ในช่องทางส่งงานนานถึง 3 เดือน
ขอให้ผู้ว่าจ้างเซฟงานเก็บ และรักษาตัวงานไว้นะคะ เพราะไม่มีการันตีว่าหากคอมพิวเตอร์ของเราจะมีปัญหาหรือไม่ ซึ่งหากไฟล์สูญหายหลังพ้น 3 เดือนไปจะขอไม่รับผิดชอบทุกกรณีค่ะ
8. หากไม่ต้องการให้เผยเแพร่ผลงานเลย จะคิดราคาชาร์จเงินเพิ่มค่าปิดผลงานเป็นความลับ 10% นะคะ
9. งาน YCH ที่ผู้วาดทำไม่ใช่เบสแจกฟรี ไม่อนุญาตให้นำไปแจกจ่าย หรือใช้ต่อ
10. ไม่อนุญาตให้นำภาพไปใช้ต่อยอดกับ AI generator, blockchain, NFT โดยเด็ดขาด หากพบเห็นภายหลังว่ามีการนำไปทำจะปรับเป็นเงินจำนวน 10 เท่าจากราคาคอมมิชตั้งต้นของภาพนั้น ๆ
11. ผู้ว่าจ้างมีหน้าที่แจ้งข้อมูลและรายละเอียดสำคัญที่เกี่ยวข้องกับคอมมิชชั่นทุกประการ การแจ้งไม่ครบหรือไม่ชัดเจนอาจส่งผลให้ผลงานที่ออกมาไม่ได้เป็นตามที่ผู้ว่าจ้างประสงค์ ซึ่งจะถือเป็นความรับผิดชอบของผู้ว่าจ้าง
12. การแก้ไขงานเกินโควต้า หรือการแก้ไขงานที่เป็นจุดใหญ่มาก เช่น เปลี่ยนท่าทางหลังจากสเก็ตช์ผ่านไปแล้ว จะมีการชาร์จค่าใช้จ่ายในส่วนนี้เพิ่ม

การสั่งงาน

• ในการบรีฟสามารถบรีฟได้ทั้งแบบละเอียด หรือจะเป็นในรูปแบบ omakase, skeb, artsign ก็ได้ค่ะ
• หากต้องการงานไซส์ไหนเป็นพิเศษขอให้แจ้งตั้งแต่ตอนส่งบรีฟนะคะ
• กรณีบรีฟแบบละเอียด ไม่จำเป็นต้องวาดภาพมาก็ได้ค่ะ แต่หากกลัวเราไม่เห็นภาพจะวาดประกอบมาก็ได้เช่นกัน ไม่มีปัญหา
• ภาพที่วาดมาขอให้เป็นภาพที่คิดขึ้นเองไม่ได้ไปทำซ้ำจากใครนะคะ เพื่อป้องกันไม่ให้มีปัญหาการละเมิดลิขสิทธิ์ในอนาคตค่ะ
• หากต้องการงานฟินิชที่ใกล้เคียงกับแบบใดเป็นพิเศษ ผู้ว่าจ้างสามารถแนบภาพตัวอย่างได้ โดยทางผู้วาดจะทำการดัดแปลงไม่ให้เหมือนภาพต้นแบบ หรือหากต้องการภาพที่ "เหมือนกับ" ผลงานนักวาดคนอื่นจริง ๆ ทางผู้วาดมีสิทธิ์ที่จะปฏิเสธไม่รับงานเพื่อป้องกันปัญหาการละเมิดลิขสิทธิ์ในอนาคต
• สามารถส่งบรีฟมาสอบถามรายละเอียดจากนักวาดก่อนได้ค่ะ ทั้งนี้ในส่วนของราคาหากมีการเปลี่ยนแปลงจะยึดรอบปัจจุบันที่ผู้จ้างจองคิวได้
• จะเป็นประโยชน์ และประหยัดเวลากับเรามากหากมีรายละเอียดตามที่เพิ่มเติมตามนี้ค่ะ : บรีฟคร่าว ๆ, จุดประสงค์การใช้งาน, เดดไลน์, งบที่สะดวกจ่าย

การยกเลิกงาน / รีฟันด์ / ชดเชย

• สามารถแจ้งยกเลิกงานหากยังไม่ถึงคิวค่ะ แต่ค่าจองคิวจะไม่ได้รับคืนนะคะ
• กรณีที่คุยตกลงงานกันแล้ว และเราเริ่มงานไปแล้ว หากมีการยกเลิกกลางทาง เราจะขอริบค่ามัดจำไว้เป็นค่าสเก็ตช์ค่ะ
• กรณีที่เรามีเหตุทำให้ต้องส่งงานล่าช้า ที่ไม่ใช่เหตุฉุกเฉิน
1) กรณีเป็นงานราคาต่ำกว่า 4500 หรืองานรอบทดลอง ทางนักวาดจะขอชดเชยเป็นภาพแถมเล็กน้อย หรือส่วนลดในครั้งหน้า (ซึ่งสามารถจองคิวรอบถัดไปได้เลยไม่จำเป็นต้องวิ่งจอง)
2) กรณีเป็นงานมูลค่า 4500 ขึ้นไป ทางผู้ว่าจ้างสามารถเรียกคืนค่าเสียเวลาเป็นราคา 100 บาทต่อจำนวนวันที่เลท (หรือสามารถตกลงกันเป็นภาพแถมได้ค่ะ)
• กรณีที่การล่าช้าเกิดจากทางผู้จ้างเอง จะไม่มีการชดเชยให้ค่ะ รวมถึงตารางงานอาจจะถูกเลื่อนไปตามตารางงานของนักวาดในช่วงนั้น ๆ ด้วย
• จะมีการคืนเงินเต็มจำนวนในกรณีที่นักวาดจำเป็นต้องยกเลิกงานเนื่องจากเหตุไม่พร้อมกะทันหัน หรือเหตุฉุกเฉินจำเป็น โดยตัวนักวาดจะมาแจ้งก่อนเองทุกครั้งค่ะ
เหตุฉุกเฉิน = อุบัติเหตุ, เจ็บป่วยรุนแรงกะทันหัน, คนในบ้านเข้าโรงพยาบาล, สัตว์เลี้ยงเจ็บหนัก หรือตาย เป็นต้น

ระยะเวลาทำงาน

• ผู้วาดอาจจะไม่ได้ตอบข้อความในทันที โดยปกติจะตอบกลับภาย 3 วันค่ะ หากเกินกว่านั้นสะกิดได้เลยค่ะ บางทีโนติเราอาจไม่แจ้งเตือน
• ผู้วาดมีตารางเวลาในการตอบแชทคุยงานในแต่ละวันอยู่ค่ะ ปกติจะทำงานตามตารางนั้น ๆ + ปิดทุก noti อยู่แล้ว เน้นเข้าไปเช็กเองตามตาราง ดังนั้นอาจจะไม่ได้ตอบเลยในทันทีนะคะ
• งานหนึ่งจะใช้เวลา 10 วัน – 2 เดือน หากต้องใช้เวลามากกว่านั้น ผู้วาดจะทำการแจ้งก่อนเริ่มงานทุกครั้ง
• งานเร่ง งานแทรกกะทันหันที่ต้องการงานภายในระยะเวลาก่อน 1 เดือน ผู้วาดจะขอชาร์จเงินเพิ่มอย่างน้อย 25% จากราคาเต็มของชิ้นงาน

ลำดับการทำงาน และอื่น ๆ

• ช่วงเวลาที่รับงานมาเราจะมีวาดเล่นเป็นระยะด้วย ปกติวาดเล่นเป็นการพักสำหรับเราค่ะ
• โปรดงดเว้นการทวงงาน หรือสอบถามความคืบหน้าหากยังไม่ถึงเวลาเดดไลน์ เว้นมีเหตุจำเป็นเช่นจะไม่อยู่กระทันหันอาจจะทำให้ไม่สามารถส่ง feedback กลับได้ในช่วงเวลาหนึ่งสามารถมาแจ้งก่อนได้นะคะ
• ในตารางคิวเรียงตามลำดับที่ทำให้นักวาดสามารถดูงานได้สะดวก มีเดดไลน์เขียนไว้ชัดเจน
• แต่ในตอนทำงานนั้นนักวาดอาจจะมีทำข้ามไปข้ามมาบ้าง เพราะการทำงานบางประเภทหรือบรีฟบางอย่างติดกัน จะส่งผลกระทบให้ตัวงานออกมาไม่ดี รวมถึงใช้เวลามากกว่าปกติ
• ทั้งนี้นักวาดจะยึดเดดไลน์ส่งงานวันสุดท้ายเป็นหลัก หากทำไม่ได้ตามเดดไลน์เดิมยินดีชดเชยให้ตามเงื่อนไขชดเชยข้างบนค่ะ

ไม่อนุญาตให้ติดต่อโทรหรือส่งข้อความผ่านการพูดคุยปากเปล่าหรือเบอร์มือถือ
(เบอร์โทรใช้สำหรับการทำเรื่องธุรกรรมต่าง ๆ ในบริษัทเท่านั้น ไม่ใช่ช่องทางติดต่องาน)

(สำหรับคนที่ผ่านเข้ามาสามารถ copy หน้า t.o.s. ไปปรับใช้ได้เลยโดยไม่ต้องขอค่ะ)

เงื่อนไขอื่น ๆ เป็นไปตามแต่การตกลงคุยงานกันอีกทีค่ะ หากมีข้อสงสัยอะไรสามารถสอบถามได้เลยนะคะ

TERM OF SERVICE

1. By purchasing my services (art), you automatically agree to the following conditions. If you do not accept this condition, the artist can refuse your request.
2. I have rights over my artwork. (If it’s your OC, the character design still belongs to you)
3. If you want a commercial use please tell me first – Commissioner may not use the Artwork for redistribution or external projects, commercial or non-commercial (i.e. t-shirts, mugs, public flyers, etc.) unless otherwise discussed.
4. Commissioners are NOT authorized to trace over my Artwork in any way, including the use of the artwork as a “base.”
5. Commissioner may use the Artwork for personal use including but not limited to: avatars, phone or computer wallpapers, and personal website/profile displays, but you can NOT claim credit (I’ll appreciate if you give a credit to me as ‘LavyPlus’ <3)
6. Commissioners can adjust color, insert text and crop art for use if we agree.
7. After I finish work I’ll publish all the commissions (with re-size and have watermark) in my SNS. If you would not like me to post the artwork on my media(above), please tell me first.
8. The artist will keep the work google drive for up to 3 months, Commissioner must keep your commission, don’t lose it. Because there is no guarantee that my computer will have a problem or not. If the file is lost after 3 months, I will not be responsible in any case.
9. If the commissioner wants to not reveal the work at all, will ask for an additional 10% from the full price.
10. I do not allow my art to be used for AI purposes and alike. Please do not upload it to any AI sites as this could compromise my artwork. NFT usage is strictly forbidden including blockchain too. If it is later discovered that it has been used, the fine will be 10 times the original commission price of that image.
11. I don't accept fan art work. Officials have rules prohibiting the production of works for profit through commissions.
12. Work that is a VTuber-related product can only be obtained from the VTuber or the manager. In the case of fan-made work, it will only be counted as fan art (Tier 2). It is not allowed to be used to increase sales.
13. The Client must specify the content of the Commission to the best of their ability. The Client is responsible for providing important information and a clear description / reference to the Artist prior to a Commission Agreement. Failing to provide information may result in the Artist’s inability to complete the Commission to the Client’s fullest satisfaction, in which the Client will be held responsible.
14. Revision work exceeding quota or editing very large points of work, such as changing poses after a sketch has approved. There will be an additional fees for this part.

ORDERING

• In ordering, you can write specific details. Or request freestyle like omakase, Skeb, artsign as well.
• Detailed commission pricing can be found on this website, Vgen or according to the details of each round of announcements. All prices are just guidelines.
• I will work only after the money has been paid.
• Please read carefully. In case you want another display size, please inform me first.
• Commissioner can attach a sample image of my work.

CANCELATION / REFUNDS / CHARGEBACK

• You can cancel your order free incase I still don’t start your queue.
• In case I already start working I’ll forfeit the deposit as a sketch fee.
• In the event that I have reasons to delay the delivery of work non-emergency The commissioner can refund the cost of wasting time at a price of 5 USD per late days.
• A full refund will be issued in case the artist needs to cancel the artwork due to sudden unavailability. or emergency necessary The artist will come to inform first every time.

SCHEDULING / DEADLINES

• I may not reply to messages immediately. Normally, I will reply within 3 days. If it’s more than that, you can chat with me again. Maybe it’s not notified.
• I have a break time for drawing on my own.
• I don’t work on weekends, holidays nor night time. Time zone is GMT+7. Therefore, I will not reply to messages outside of working hours. even though i’m online. (or you can check specific date on my sheet queue.)
• One artwork takes 10 days – 2 months. I will be notified before starting work every time.
• Urgent work, if work is required within 1 month, the artist will request to charge at least 25% of the full price of the work.

1. จะสะดวกสำหรับนักวาดมากหากแจงงบที่สะดวกมาแต่แรกเพื่อเราจะได้ปรับงานไปตามงบอีกทีค่ะ

1. การให้จัดไฟล์เป็นที่คั่น หรือโปสการ์ดจากภาพเดิม (หากมีเดดไลน์ที่ต้องการใช้กรุณาแจ้งก่อนตั้งแต่ตอนส่งบรีฟนะคะ)
2. กรณีที่ตัวเล่มยังอยู่ระหว่างพิมพ์ สามารถมาให้เราปรับไซส์สันหลังจากรู้ไซส์แล้ว หรือปรับตัวอักษรราคาในภายหลังได้ค่ะ
3. หากนำไปลงแพลตฟอร์มที่มีแบนเนอร์ไว้โฆษณาสามารถแจ้งมาได้ค่ะ เราจะทำไซส์แบนเนอร์สำหรับโฆษณาให้ด้วย โดยใช้อาร์ตเดิม
